1. Acceptance of Terms
By accessing or using the QA Today website and services, you agree to be bound by these Terms of Service. If you do not agree to all of the terms and conditions, then you may not access the website or use any of our QA testing services.
2. Description of Services
QA Today provides outsourced software testing services, including manual exploratory testing, test automation (Playwright/Cypress), performance load testing, and security vulnerability audits. We operate on both fixed-bid project contracts and ongoing QA staff augmentation retainers.
3. Client Responsibilities
As a client, you agree to provide our testing team with the necessary access to staging environments, documentation, APIs, and credentials required to perform the agreed-upon QA services. You are responsible for ensuring that testing against your systems does not violate any third-party agreements or cloud provider terms of service.
4. Confidentiality and Intellectual Property
All source code, proprietary algorithms, pre-release software, and business logic shared with QA Today remains your exclusive intellectual property. QA Today retains the rights to any generic test automation frameworks, CI/CD scripts, or utility libraries developed during the engagement unless specifically stated as "Work for Hire" in a signed Master Services Agreement (MSA).
5. Limitation of Liability
While QA Today utilizes ISTQB-certified engineers and industry-leading testing methodologies to identify defects, we cannot guarantee that 100% of all software bugs or security vulnerabilities will be found. QA Today shall not be held liable for any direct, indirect, incidental, or consequential damages resulting from undiscovered defects reaching production environments.
6. Payment Terms
Payment terms will be explicitly outlined in the corresponding Statement of Work (SOW) or invoice. Failure to pay invoices within the agreed net terms may result in a suspension of active testing services or the withholding of final test reports and automation repositories.
7. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any significant changes. What constitutes a significant change will be determined at our sole discretion.
